Биргелешип ажырашуу: ал Нидерландияда кандайча иштейт жана качан туура келет

Эки адам столдун үстүндө кол алышып учурашып отурушат, үчүнчүсү карап турат, сыртта канал көрүнүп турат

Collaborative divorce (overlegscheiding) is a way of settling a divorce in which each spouse has their own lawyer and everyone signs an agreement to reach a settlement without going to court. If the talks fail, both lawyers must withdraw; and even when they succeed, the district court must still pronounce the divorce on a joint petition.

What is collaborative divorce, and what is it not?

Нике шакектерин мыйзамдуу документтин үстүнө алмаштырып жаткан эки кол никенин бүтүшүн билдирген.

It is a contractual negotiation method, not a separate legal procedure. No Dutch statute regulates it; its features come from the participation agreement the spouses and their lawyers sign.

Three elements define it. Each spouse has their own lawyer at every meeting, who advises only that spouse; in mediation one neutral mediator guides both and advises neither. Everyone commits in writing to negotiate in good faith and to disclose all financial information. And a disqualification clause provides that if the dispute goes to court, both lawyers step aside and new lawyers must be instructed.

The disqualification clause takes the threat of litigation off the table, because carrying it out costs both sides their adviser and the fees already paid. That is why the choice for this method must be made deliberately at the start.

Is what you say in the process confidential?

Only by contract. Dutch law gives mediators and collaborative professionals no statutory right to refuse to give evidence, so confidentiality rests on the participation agreement and on the lawyers’ professional duty of confidentiality.

The agreement should state that discussions and proposals cannot be used in later proceedings, and what happens to documents and expert reports if the process ends. Information that exists independently, such as bank statements, does not become confidential by sharing it at a meeting.

What does Dutch law require on any route?

Under Articles 1:150 and 1:151 of the Dutch Civil Code (BW) the court pronounces the divorce at the request of one or both spouses, on the single ground that the marriage has irretrievably broken down (duurzame ontwrichting). No fault is examined.

Three formal requirements apply to a collaborative settlement just as to a contested case:

  • A lawyer files the petition. A divorce petition must be filed by an advocaat. On a joint petition one lawyer can file for both spouses.
  • A parenting plan for minor children. Under Article 815 of the Dutch Code of Civil Procedure (Rv) the petition must contain a parenting plan signed by both spouses, covering the division of care and upbringing, how you inform and consult each other, and the costs of care and upbringing. Our guide on the ажырашкан учурда ата-эне планы explains what a workable plan contains.
  • Registration within six months. Under Article 1:163 BW the divorce only takes effect when the decision is registered in the civil register. If registration is not requested within six months after the decision becomes final, the decision loses its force.

A decision becomes final when the three-month appeal period under Article 358 Rv has expired, unless both spouses sign a deed of acquiescence (akte van berusting), which makes it final at once. Joint parental authority continues after the divorce; the parenting plan divides the care, not the authority.

How does a collaborative divorce run?

Бир үстөлдүн тегерегине отуруп, документтерди биргелешип карап, планды талкуулап жаткан ар түрдүү адистер тобу.

The process has four stages. Knowing them helps you judge whether it is run properly.

Stage 1: separate consultations and the team

Each spouse first meets their own lawyer alone for a frank assessment of what a court would likely decide. Without that, you negotiate blind.

The two spouses and two lawyers form the core team. Where needed, neutral specialists join: a financial expert to map assets, debts, income and pensions, and a child specialist for the parenting plan. Each specialist adds cost, so add one only for a real question.

Stage 2: the participation agreement

Nothing is negotiated before this agreement is signed. It records the commitment to stay out of court, full disclosure, confidentiality, the disqualification clause, cost sharing and how the process ends.

Check whether the neutral expert’s report may be used, and whether the expert may be instructed again, if the process fails. That report is often the most valuable work product.

Stage 3: joint meetings and disclosure

The joint meetings establish the facts: property, income, business interests, pensions, debts and the children’s situation. Disclosure is voluntary; there is no court order compelling it.

The legal sanction for concealment is severe. Under Article 3:194(2) BW a spouse who intentionally conceals or hides assets of the community forfeits their share in those assets to the other spouse. Mention this rule in the first meeting.

Stage 4: settlement and the court

The agreement is recorded in a divorce settlement (echtscheidingsconvenant), signed and filed with the joint petition. The court checks the arrangements for the children against their interests; the financial arrangements between adults are in principle left to them.

Under Article 809 Rv the court gives children of 12 and older the opportunity to give their view before deciding matters that concern them, and may hear younger children. If the parents’ interests conflict with those of the child, the court can appoint a special representative (bijzondere curator) under Article 1:250 BW.

How does it compare with mediation and court proceedings?

The three routes differ in who decides, who advises and what happens if agreement fails. In all three, the divorce itself is pronounced by the district court.

Two lawyers and often a neutral expert make the hourly cost higher than mediation. Contested proceedings with interim applications, valuations and an appeal are usually the most expensive. Which issues must you settle on every route?

Жубайлар адвокаттары менен бир столдо конструктивдүү жана токтоо мамиле менен документтерди карап отурушат.

A collaborative process changes how decisions are made, not which decisions are needed. Five subjects come up in almost every Dutch divorce.

Никелик мүлк

Marriages entered into from 1 January 2018 fall under a limited community of property: under Article 1:94 BW, assets each spouse owned alone before the marriage, gifts and inheritances stay outside it. Older marriages are in principle under the general community, unless prenuptial conditions apply.

Under Article 1:100 BW the spouses share the dissolved community equally, unless agreed otherwise. Our article on the чектелген мүлк жамааты explains where the line falls. Mixed private and community money in one account is hard to separate years later, so keep records.

Жубайларды багуу

The amount depends on need and capacity, calculated with the judiciary’s guidelines (Tremanormen). The duration is set by Article 1:157 BW: half the length of the marriage, with a maximum of five years, for petitions filed from 1 January 2020.

The term is longer if a child of the marriage is under 12 (until the youngest turns 12), or after a marriage of more than 15 years if the recipient is close to the state pension age or was born on or before 1 January 1970. Our article on өнөктөштүн алименти жана AOW жашы covers the end date.

Балдарды багуу

Parents must contribute to the costs of their children, and under Article 1:395a BW until the child turns 21. The amount follows the alimony guidelines, based on the child’s needs and each parent’s capacity.

The guidelines change every year and the amounts are indexed each 1 January under Article 1:402a BW. Record the calculation method in the settlement, not only a fixed figure.

пенсия

Under the Pension Rights Equalisation Act (Wet verevening pensioenrechten bij scheiding) each spouse is in principle entitled to half of the old-age pension the other built up during the marriage. You may agree otherwise in writing, for example conversion into an independent right.

Notify the pension provider with the official form within two years of the divorce (Article 2(2) of that Act). The provider then pays the share directly. If you miss that deadline, you must collect it from your former spouse.

Эл аралык никелер

Jurisdiction in divorce and parental responsibility within the EU follows Regulation (EU) 2019/1111 (Brussels II ter), which applies since 1 August 2022. Often several courts are competent, and the court first seised keeps the case.

The Netherlands does not take part in the Rome III Regulation. Under Article 10:56 BW a Dutch court applies Dutch law to the divorce, unless the spouses validly choose the law of a common foreign nationality. For marriages from 29 January 2019, Regulation (EU) 2016/1103 governs the property regime. See our article on эл аралык үй-бүлөлөр жана кайсы Нидерландия сотунун юрисдикциясы бар. We do not advise on tax; involve a tax adviser before the settlement is signed.

The family home

If you keep owning the home together, both of you stay liable for the mortgage, whoever lives there. The bank is not obliged to release either of you.

Make any agreement on the home conditional on written confirmation from the lender that it releases the departing spouse from liability.

When is collaborative divorce the wrong choice?

It does not fit where there is violence, urgency, hidden assets or a pure point of law. In those cases the court has tools a negotiation lacks.

  • Domestic violence or coercive control. A method based on voluntary disclosure and equal negotiation cannot correct that imbalance and may be unsafe.
  • Өзгөчө кырдаал. If a spouse empties accounts, refuses to leave the home or takes the children abroad, you can ask the court for provisional measures under Article 821 Rv; the hearing starts no later than the third week after the request. See our article on ажырашуу процессиндеги убактылуу чаралар.
  • Suspected hidden assets. Then you need court instruments, such as an order to produce specific records or an attachment.
  • A genuine point of law. The validity of prenuptial conditions or the applicable law in an international marriage needs an authoritative answer from a court.

Starting collaboratively and abandoning the process later means paying for two sets of lawyers. Make this assessment at the start.

Why does the method suit parents?

Көп муундуу үй-бүлө сейил бакта жылмайып, сакталып калган мамилелерди чагылдырууда.

Parents keep consulting each other on school, health and holidays for years after the divorce. Under Article 815 Rv they must also agree on how they will inform and consult each other.

A settlement both parents designed tends to be complied with more readily than an imposed order. That is no reason to accept a bad settlement: your own lawyer at the table checks that the agreement is legally sound. Our guide on Нидерландиядагы ажырашуу мыйзамы sets out the full framework.

Баштоодон мурун эмнени текшеришиңиз керек?

Check these points before you sign the participation agreement.

  • Is there any violence, intimidation or urgency that requires court measures under Article 821 Rv?
  • Does the agreement say what happens to the expert report and the work product if the process fails?
  • Have both lawyers given a written cost estimate per stage?
  • Are all assets on the table, including foreign assets, accounts in one name and company interests?
  • In an international case: which court has jurisdiction and which law applies?
  • Do you have the documents ready: marriage certificate, prenuptial conditions, mortgage statements, two years of tax returns, pension overviews and company details?

What can we do for you with a collaborative divorce?

биздин ажырашуу адвокаттары advise on collaborative divorce, mediation and, where unavoidable, proceedings.

  • We review or draft the participation agreement, including the confidentiality and disqualification clauses.
  • We draft and review the divorce settlement and the parenting plan.
  • We check the property division, maintenance calculation and pension equalisation.
  • We establish jurisdiction and applicable law in an international divorce.
  • We file the joint petition and arrange registration within the six-month deadline.

Жыйынтык

  • Collaborative divorce is a contractual method: each spouse has their own lawyer and both lawyers withdraw if the process fails.
  • The court still pronounces the divorce on a petition filed by a lawyer, with a parenting plan if there are minor children (Article 815 Rv).
  • The divorce only takes effect when registered within six months after the decision becomes final (Article 1:163 BW).
  • Confidentiality rests on the participation agreement, not on statute.
  • Violence, urgency or hidden assets call for the court, not for negotiation.

Көп берилүүчү суроолор

What happens if we cannot reach an agreement?

Both collaborative lawyers withdraw and may not act in the court proceedings that follow; each spouse instructs a new lawyer. Check in advance whether the neutral expert report can still be used.

Is collaborative divorce cheaper than going to court?

Usually, but not per hour: two lawyers and often an expert are involved. The saving comes from avoiding interim applications, valuations, hearings and a possible appeal. Ask both lawyers for a written estimate per stage.

Can the process work if there is a lot of conflict?

Anger and distrust can be managed within the structure of the process. An imbalance of power, refusal to disclose or safety concerns cannot; then the court route under the Code of Civil Procedure is more suitable.

Do we still need to go to court?

Yes. The district court pronounces the divorce on a joint petition filed by a lawyer, and the divorce takes effect only when registered in the civil register within six months after the decision becomes final (Article 1:163 BW). The hearing is often short or not needed.
